15 US states have either proposed or enacted legislation requiring online companies to protect the safety and privacy of children using their platforms. Today, these states are also trying to ‘lobby’ Congress to quickly pass federal legislation on the matter. Of all the states, California was one of the first as early as 2021, with a law requiring social media and online companies to prioritise the health and privacy of young children. However, the law was blocked by a lawsuit filed by NetChoice, but despite this other states have proposed similar laws that follow the Californian approach of age-appropriate design and require parental consent.
