Secondo una analisi condotta da Bloomberg Law un gran numero di aziende, a partire dal 2022, si sono viste raggiungere da querela perché molti avvocati, interpretando un vecchio statuto, le hanno ritenute responsabili di aver tracciato i video visionati dai loro visitatori on line senza aver raccolto il loro consenso. Ma a dispetto dell’iniziale fiammata in favore dei querelanti i tribunali interessati stanno restringendo non solo la portata delle richieste di risarcimento collettivo ma anche il numero dei risarcimenti.

CANADA, DATA BREACH, IL GOVERNO FEDERALE HA ANNUNCIATO UNA VIOLAZIONE DEI DATI CHE COINVOLGE I PROPRI DIPENDENTI
Il governo canadese ritiene che la protezione dei dati personali dei suoi dipendenti sia una priorità. Il 19 ottobre scorso però, Brookfield Global Relocation Services (BGRS) ha informato ii responsabili del Governo di una violazione delle informazioni contenute nei sistemi BGRS e SIRVA Canada. Da questo momento è stata intrapresa un’azione immediata per mitigare i danni e indagare sulla violazione, che coinvolge le informazioni in possesso delle società sui dipendenti attuali ed ex del governo canadese, sui membri delle forze armate canadesi e sul personale della Royal Canadian Mounted Police. L’incidente è stato segnalato anche al Canadian Centre for Cyber Security, all’Office of the Privacy Commissioner e alla Royal Canadian Mounted Police.

US, DECLINE IN CLASS ACTIONS AGAINST COMPANIES FOR DISCLOSING AN INDIVIDUAL’S VIDEO VIEWING HISTORY WITHOUT CONSENT
According to an analysis conducted by Bloomberg Law, a large number of companies have been facing lawsuits since 2022 because many lawyers, interpreting an old statute, have held them liable for tracking the videos viewed by their online visitors without collecting their consent. But in spite of the initial flare-up in favour of the plaintiffs, the courts concerned are restricting not only the scope of collective claims but also the number of settlements.
CANADA, DATA BREACH, THE FEDERAL GOVERNMENT HAS ANNOUNCED A DATA BREACH INVOLVING ITS EMPLOYEES
The Canadian government considers the protection of its employees’ personal data to be a priority. However, on 19 October, Brookfield Global Relocation Services (BGRS) informed government officials of a breach of information contained in the BGRS and SIRVA Canada systems. Immediate action was taken to mitigate the damage and investigate the breach, which involved information held by the companies on current and former Canadian government employees, members of the Canadian Armed Forces and Royal Canadian Mounted Police personnel. The incident was also reported to the Canadian Centre for Cyber Security, the Office of the Privacy Commissioner and the Royal Canadian Mounted Police.
