NEW JERSEY, NUOVA LEGGE SULLA PRIVACY
Il governatore DEL New Jersey Phil Murphy ha firmato recentemente una legge che si prefigge lo scopo di protegge la privacy dei consumatori. La legge richiede ai siti web e i fornitori online di notificare ai clienti la modalità di raccolta e la divulgazione dei dati personali e offrano loro la possibilità di rinunciarvi. Secondo il governatore, è importante che i consumatori recuperino il controllo sui propri dati e decidano se condividerli o meno. Il procuratore generale Matthew J. Platkin considera questa legge come una delle più forti protezioni dei dati a livello nazionale. Il senatore Troy Singleton – uno degli sponsor della legge- ha sottolineato come questa legge restituisce potere che hanno così un ruolo decisionale attivo nella distribuzione dei propri dati.

EDPB, AUTORITA’ ADOTTA IL RAPPORTO SUI RISULTATI DELL’AZIONE ESECUTIVA COORDINATADEL 2023 DEL CONSIGLIO IN MATERIA DI DPO
A livello europeo sono stati introdotti dal GDPR nuovi requisisti per la designazione, la conoscenza, l’esperienza, i compiti e le risorse dei DPO, nonché sul loro ruolo e posizione all’interno delle organizzazioni. Le autorità di vigilanza hanno elaborato un questionario comune, tradotto in 24 lingue, che è stato inviato agli stakeholder nazionali. Obiettivo della somministrazione del questionario è per raccogliere dati statistici e qualitativi sul profilo, la posizione e il lavoro dei DPO. Il documento di fornisce raccomandazioni per affrontare le sfide emerse quali ad esempio l’assenza di designazione di un DPO anche se obbligatoria; le risorse insufficienti allocate ai DPO; la conoscenza e la formazione insufficienti dei DPO; i DPO che non sono pienamente o esplicitamente incaricati dei compiti richiesti dal GDPR; i conflitti di interessi e la mancanza di indipendenza dei DPO; la mancanza di segnalazione dei DPO al livello di gestione più alto delle organizzazioni; la richiesta di ulteriori orientamenti da parte delle autorità di vigilanza. Il documento fornisce anche una panoramica delle azioni già intraprese o in corso da parte delle autorità di vigilanza.
USA, LA FTC FIRMA UN ACCORDO MULTILATERALE PER RAFFORZARE LA COOPERAZIONE IN MATERIA DI TUTELA DELLA VITA PRIVATA E DELLA SICUREZZA DEI DATI
La FTC – Federal Trade Commission – ha accettato di partecipare all’accordo internazionale Global Cooperation Arrangement for Privacy Enforcement (Global CAPE), che consente all’agenzia di collaborare e condividere informazioni con altre autorità per la privacy in tutto il mondo. Questa partecipazione aiuta l’agenzia a ad essere al passo con la dimensione globale che nel corso degli anni ha assunto il mondo del commercio, facilitando – al contempo – la cooperazione su questioni di sicurezza e privacy dei dati senza dover negoziare accordi separati con ogni paese partecipante. Il Global CAPE è stato creato per integrare le Regole sulla privacy transfrontaliera della Cooperazione economica dell’Asia e del Pacifico, consentendo la partecipazione anche di paesi al di fuori di questa area

NEW JERSEY, NEW PRIVACY LAW
New Jersey Governor Phil Murphy recently signed a law aimed at protecting consumer privacy. The law requires websites and online vendors to notify customers of how they collect and disclose personal data and offer them the opportunity to opt out. According to the governor, it is important that consumers regain control over their data and decide whether or not to share it. Attorney General Matthew J. Platkin sees this law as one of the strongest data protections nationwide. Senator Troy Singleton – one of the bill’s sponsors – emphasised how this law gives power back to consumers who thus have an active decision-making role in the distribution of their data.

EDPB, AUTHORITY ADOPTS REPORT ON THE RESULTS OF THE COUNCIL’S 2023 COORDINATED EXECUTIVE ACTION ON DPO
At European level, the GDPR introduced new requirements for the designation, knowledge, experience, tasks and resources of DPOs, as well as their role and position within organisations. The supervisory authorities developed a common questionnaire, translated into 24 languages, which was sent to national stakeholders. The purpose of the questionnaire is to collect statistical and qualitative data on the profile, position and work of DPOs. The paper of provides recommendations to address the challenges that emerged such as the absence of designation of a DPO even if mandatory; insufficient resources allocated to DPOs; insufficient knowledge and training of DPOs; DPOs who are not fully or explicitly entrusted with the tasks required by the GDPR; conflicts of interest and lack of independence of DPOs; lack of reporting of DPOs to the highest management level of organisations; and the request for further guidance from supervisory authorities. The paper also provides an overview of actions already taken or in progress by supervisory authorities.
USA, FTC SIGNS MULTILATERAL AGREEMENT TO STRENGTHEN PRIVACY AND DATA SECURITY COOPERATION
The FTC – the Federal Trade Commission – has agreed to participate in the international Global Cooperation Arrangement for Privacy Enforcement (Global CAPE), which allows the agency to collaborate and share information with other privacy authorities around the world. This participation helps the agency keep pace with the global dimension that the world of commerce has taken on over the years, while facilitating cooperation on data privacy and security issues without having to negotiate separate agreements with each participating country. The Global CAPE was created to complement the Asia-Pacific Economic Cooperation’s Cross-Border Privacy Rules, allowing countries outside this area to participate as well
