OLANDA, AUTORITA’ PER LA PROTEZIONE DEI DATI HA INFLITTO UNA MULTA DI 10 MILIONI DI EURO A UBER
In Olanda l’Autorità per la protezione dei dati ha inflitto ad Uber una multa di 10 milioni di euro per la mancata divulgazione dei dettagli sui periodi di conservazione dei dati degli autisti europei e sulla condivisione di questi dati con Paesi extraeuropei. La DPA ha anche rilevato che Uber ha ostacolato gli autisti nel loro diritto alla privacy, rendendo complicato presentare richieste di accesso ai propri dati personali. L’app che veniva utilizzata per gli autisti conteneva un modulo di richiesta di accesso, ma era nascosto, il che lo rendeva difficile da trovare. Inoltre, Uber non ha specificato per quanto tempo conserva i dati degli autisti né quali misure di sicurezza adotta quando li invia ai Paesi al di fuori del SEE. L’Autorità ha sottolineato che la trasparenza è fondamentale per la protezione dei dati personali e che gli autisti hanno il diritto di sapere come vengono gestiti i propri dati. Uber dovrebbe agevolare gli autisti nell’esercizio del loro diritto alla privacy.

SPAGNA, AEDP HA PRESENTATO LA SUA STRATEGIA PER PROMUOVERE UN EFFICACE PROTEZIONE DEI BAMBINI E DEGLI ADOLESCENTI IN INTERNET
L’AEDP, Agenzia spagnola per la protezione dei dati, ha presentato la sua Strategia sui minori, la salute digitale e la privacy. Il documento consta di 10 azioni prioritarie e 35 misure per promuovere la protezione dei bambini e degli adolescenti nell’uso di Internet e dei suoi servizi. Le azioni si concentrano sulla cooperazione normativa, il rafforzamento dei diritti dei minori e l’esercizio dei poteri investigativi e sanzionatori. L’AEPD promuoverà anche una legge per la protezione dei minori attraverso il coordinamento di un gruppo di lavoro che parteciperà alla stesura delle linee guida dell’UE sui minori e promuoverà la regolamentazione del trattamento dei dati per garantire i diritti dei bambini. In aggiunta l’AEDP promuoverà la produzione di app per la verifica dell’età dei minori e collaborerà con diverse organizzazioni. Inoltre, collaborerà con l’Istituto Nazionale di Cybersecurity (INCIBE) e l’Istituto Nazionale per le Tecnologie dell’Educazione e la Formazione degli Insegnanti (INTEF) per fornire formazione e risorse digitali alle famiglie. L’AEPD ispezionerà anche le piattaforme e gli strumenti digitali nelle scuole per garantire la conformità alle norme sulla protezione dei dati.

Il garante della Privacy di Hong Kong ha effettuato delle irruzioni negli uffici del progetto di criptovaluta Worldcoin dopo aver scoperto che il progetto stava raccogliendo le informazioni biometriche dell’iride dei partecipanti. L’Ufficio del Commissario ha ottenuto un mandato di perquisizione ed è emerso che i partecipanti potevano registrarsi per il passaporto digitale del progetto, consentendo al progetto di ottenere le informazioni biometriche dell’iride e di ricevere un token Worldcoin gratuito. In un comunicato l’Ufficio ha sottolineato che l’iride è un’informazione biometrica personale unica e molto sensibile che non può essere modificata e che potrebbe causare gravi conseguenze in caso di perdita di dati, ha ritenuto che il progetto potesse aver violato le normative sulla privacy e ha invitato il pubblico a proteggere le proprie informazioni personali e a non partecipare a attività che coinvolgono la raccolta di dati personali sensibili.

HOLLAND, WATCHDOG FINED UBER EUR 10 MILLION
In the Netherlands, the watchdog has imposed a fine of EUR 10 million on Uber for failing to disclose details of the retention periods of European drivers’ data and the sharing of this data with non-European countries. The DPA also found that Uber hindered drivers in their right to privacy by making it complicated to submit requests for access to their personal data. The app that was used for drivers contained an access request form, but it was hidden, which made it difficult to find. Furthermore, Uber did not specify how long it keeps drivers’ data or what security measures it takes when sending them to countries outside the EEA. The Authority emphasised that transparency is crucial for the protection of personal data and that drivers have the right to know how their data is handled. Uber should make it easier for drivers to exercise their right to privacy.

SPAIN, AEDP PRESENTED ITS STRATEGY TO PROMOTE EFFECTIVE PROTECTION OF CHILDREN AND ADOLESCENTS ON THE INTERNET
The Spanish Data Protection Agency, AEDP, has presented its Strategy on Children, Digital Health and Privacy. The document consists of 10 priority actions and 35 measures to promote the protection of children and adolescents when using the Internet and its services. The actions focus on regulatory cooperation, the strengthening of children’s rights and the exercise of investigative and sanctioning powers. The EYPD will also promote a child protection law through the coordination of a working group that will participate in the drafting of EU guidelines on children and promote the regulation of data processing to guarantee children’s rights. In addition, the AEDP will promote the production of age verification apps for children and will cooperate with various organisations. It will also work with the National Institute of Cybersecurity (INCIBE) and the National Institute for Educational Technology and Teacher Training (INTEF) to provide training and digital resources for families. The AEPD will also inspect digital platforms and tools in schools to ensure compliance with data protection regulations.

HONG KONG, PRIVACY WATCHDOG RAIDS WORLDCOIN OFFICES AFTER DISCOVERING THE COMPANY WAS ALLEGEDLY COLLECTING USER SCANS
Hong Kong’s Privacy Commissioner raided the offices of cryptocurrency project Worldcoin after discovering that the project was collecting participants’ biometric iris information. The Commissioner’s Office obtained a search warrant and it emerged that participants could register for the project’s digital passport, allowing the project to obtain biometric iris information and receive a free Worldcoin token. In a statement, the Office emphasised that the iris is unique and highly sensitive personal biometric information that cannot be altered and could cause serious consequences in the event of data loss, considered that the project may have violated privacy regulations, and urged the public to protect their personal information and not to participate in activities involving the collection of sensitive personal data.
